Free Items Policy

Web3.Market ("we," "us," or "our") may offer digital items at no monetary cost (“Free Items”), including NFTs and other blockchain-secured assets priced at $0 or otherwise distributed without charge. This Free Items Policy explains eligibility, licensing, usage, and limitations for such items. This Policy is incorporated into and forms part of our Terms of Use and Privacy Policy.

By claiming, minting, downloading, or otherwise accessing Free Items, you agree to this Policy. We may update this Policy periodically by posting a revised version with the effective date above; continued use after changes constitutes acceptance.

Important: Free Items are provided “as is”, may be available only in limited quantities or for a limited time, and may require you to pay blockchain network (gas) fees to claim or transfer.

1. Scope & Definitions

“Free Items” include any digital assets made available at no monetary price through the Service, such as free mints, airdrops, giveaways, or $0 listings. Unless stated otherwise in a specific listing, this Policy applies to all Free Items distributed via Web3.Market.

2. Eligibility & Access

Access to Free Items may require an account, a compatible wallet, and compliance with our Terms of Use. We may limit Free Items by region, supply, allowlist, or other eligibility criteria and may require verification to prevent fraud or abuse.

3. Costs & Gas Fees

Free Items have no monetary purchase price, but network fees (gas) and applicable taxes are your responsibility.
We are not responsible for failed claims caused by network congestion, wallet issues, insufficient gas, or third-party services.
Any displayed estimates are informational and may differ from actual fees paid on-chain.

4. Licenses & Ownership

Ownership of a Free Item is determined by the relevant blockchain records (e.g., token standards such as ERC-721 or ERC-1155). Unless a listing explicitly states otherwise:

You receive a personal, non-exclusive, worldwide license to use, display, and transfer the Free Item for personal purposes.
Commercial use is not included unless the listing or token metadata grants it.
Creators retain all copyrights and moral rights not expressly granted. Licenses tied to NFTs may be defined in the smart contract or metadata and will govern to the extent of any conflict.

5. Prohibited Conduct

Automated mass-claiming, multi-account abuse, sybil attacks, or bypassing rate limits.
Misrepresentation, fraud, or spoofing referral/airdrop mechanisms.
Removing or altering copyright, trademark, or license notices.
Using Free Items in violation of laws, third-party rights, or our Terms of Use.

Violations may result in claim denial, item revocation where technically feasible, account suspension, or other remedies permitted by law and our Terms of Use.

6. Availability, Limits & Changes

Supplies may be limited; first-come, first-served rules may apply.
We may set or change per-wallet caps, region eligibility, or time windows without notice.
We may modify, pause, or end Free Item distributions at any time.

7. Resale & Transfers

You may transfer or resell Free Items if permitted by the listing, smart contract, and applicable law. Secondary-sale royalties or on-chain restrictions (e.g., transfer locks) may apply and are enforced by the relevant contracts or marketplaces.

8. No Warranties; Support & Updates

Free Items are provided “as is” without warranties of any kind.
We do not guarantee quality, availability, authenticity, or fitness for a particular purpose.
Creators are not obligated to provide updates, fixes, or ongoing support for Free Items unless explicitly stated.

9. Data & Privacy

We may collect limited information necessary to administer Free Item distributions (e.g., wallet address, claim timestamps) consistent with our Privacy Policy. Blockchain activity is public and may be visible on-chain. For details, please review our Privacy Policy.

10. Disputes & Governing Law

Disputes related to Free Items are governed by our Terms of Use, including arbitration, class-action waiver, and governing law provisions. We are not responsible for issues caused by third-party wallets, networks, or services.
